What data we process and why

Account: your email address, to send you the sign-in code and identify your license (your plan and until when it is valid).

Payments and invoices: if you subscribe to a plan, Stripe processes the payment data. We never see or store your card; we receive your subscription status and your invoice details (name, country and, if you are a business, your tax or VAT number).

Your business content: your recipes, ingredients, customers, orders and other data are stored on your device and in the backup folder you choose. We do not upload them to our servers, except as explained in the next point.

GuIA with AI (Premium and Cloud plans): when you ask a free question or dictate an instruction, we send your question and, for questions about your business, a summary of your products, costs, prices and sales to our server and to Anthropic, which generates the answer. We never send names or details of your customers. We only store how many questions you have used each month; Anthropic does not use this data to train its models.

Use of the app: to improve it and see what works, we store with your account a few steps and the date you first take them (for example, your first product, your first order or whether you reach a limit of your plan), the last day you opened it, which link you came from, whether you use a phone, tablet or computer, whether you have it installed, your country and your language. Never the content: no recipes, prices or customers. Legal basis: our legitimate interest in improving the app; you can object by writing to us.

Founders waiting list: if you sign up on the website, we store your email, your name (if you give it), your language, your country and which link you came from, to tell you about founder places and Merkhia news. We send you an email to confirm (Resend). Legal basis: your consent, when you tick the box; you can unsubscribe at any time with the link in each email.

Voice dictation: if you use the microphone, what you say is recognized by your browser’s or phone’s system (for example, Google or Apple), under their own terms. We do not receive the audio, only the text.

Your customers’ data: you keep it, on your device. You decide what you record and you are responsible for handling it lawfully; we have no access to it.

This website does not use tracking cookies or advertising tools.

Legal basis

Performance of the contract (giving you access to the app, your plan and its features, such as GuIA) and compliance with legal obligations (invoicing and taxes).

Who we share it with

Only with the providers needed to deliver the service, under data processing agreements: Supabase (accounts and licenses, servers in the European Union), Resend (sending the sign-in code and waiting list emails), Stripe (payments and invoices), Cloudflare (hosting of the website and app) and Anthropic (GuIA AI answers, in the United States). Some process data outside the European Union with the safeguards required by the GDPR (standard contractual clauses or the EU-US Data Privacy Framework).

How long

For as long as you have an account. Billing data, for as long as the law requires (generally 6 years in Spain). Anthropic may keep GuIA requests for a short time for security.

Your rights

You can request access, rectification, erasure, objection, restriction and portability by writing to soporte@merkhia.com. If you believe they are not respected, you can complain to the Spanish Data Protection Agency (www.aepd.es) or to the authority in your country.
